It was a pleasure to arrange a networking and legal update for FMB Northern Ireland members recently at the offices of TLT in Belfast.
A fast-tracked Act with major implications
Produced in haste in response to the Victoria Square apartments case, this legislation is now law, bringing significant changes to how developers and construction businesses operate.
FMB has been lobbying hard on the challenges this act could bring on members, even in the short term.
These changes could increase the risk of legal action and raise liability insurance costs for building firms across Northern Ireland.
Key legal advice from construction specialist Nuala Maguire
The lead construction solicitor, Nuala Maguire of TLT provided a very open and informative presentation, leading to many questions and issues discussed.
There was a clear practical focus on understanding what the new Act means for business, with practical steps to manage risk and future-proof your operations. All the members who attended found it very useful and the networking at such events is always good.
What does the future look like and how are we helping?
Going forward, FMB NI and its board are continuing to work with the Department of Communities on a refined piece of legislation. As NI applies more aspects of the Building Safety Act in NI law we hope to see a review of the Defective Buildings Premises Act .
This would include looking at the liability periods for contractors, as well as applying to buildings over 11 metres rather than all projects.
Keeping pressure on policy makers
NI Director Gavin McGuire and National Board rep, Mark Gribben met with Department officials to review current legislation proposals and Departmental changes. This would also involve with a move for building regulations away from Department of Finance to Communities. Something we have lobbied for some time on.

From 2026, members of the FMB in Northern Ireland will be able to download a suite of contracts which reflects all the current changes to legislation and protects you as members. This is a real member benefit and a way you can strengthen the professional nature of your business.
